Terms of Service.

This is a working draft, not a reviewed legal document. It hasn’t been checked by a lawyer. The legal entity name, registered address, and governing-law section below are placeholders — fill them in and get this reviewed (especially the payments and liability sections) before treating it as what users are actually agreeing to.
1. Acceptance
By creating an account or otherwise using 3D Scan Garage (“the Service”), you agree to these Terms. If you don’t agree, don’t use the Service. We may update these Terms from time to time (see Section 16); continuing to use the Service after a change means you accept the update.
2. What the Service is
3D Scan Garage is a marketplace for measured 3D geometric data — mounting interfaces, clearance envelopes, hardpoints and surfaces — captured by independent scanners and, where marked, checked against the physical vehicle before publishing. It exists for engineering, R&D and the development of aftermarket or compatible parts: reference geometry to design, measure, integrate and modify against, in a defined datum and coordinate system.
3D Scan Garage is not a platform for manufacturing OEM replicas or counterfeit components. Section 5 (“Content policy”) sets out exactly what listings may and may not be used for. The Service also hosts a bounty board where buyers can signal demand for a scan nobody has captured yet.
3. Accounts
You must be at least 18 to create an account. You’re responsible for the accuracy of the information you provide, for keeping your credentials secure, and for everything that happens under your account. One account per person — accounts are not transferable. A single account can act as both a buyer and a seller.
4. Listings
As a seller, you confirm that you actually captured the data you upload (or hold the rights or permission necessary to publish it), that your description of it (precision, datum, coordinate system, equipment, formats) is accurate to the best of your knowledge, and that publishing it doesn’t infringe anyone’s rights or violate Section 5 (“Content policy”). This isn’t only a passive term you’re bound by — before a listing can be submitted for review, you have to actively confirm this in the submission form itself, and we keep a timestamp of when you did. We review listings before they go live and can reject, suspend, or remove one at any time, with or without notice, if it violates these Terms or a valid legal claim is made against it (see Section 10).
5. Content policy — permitted and prohibited use
Listings on 3D Scan Garage are licensed as reference geometry — data to design against, measure, check clearance and fit, integrate into CAD, and develop aftermarket or compatible parts from. That’s what a license under Section 7 grants, and it’s the only thing it grants.
Permitted use includes:
- Designing an aftermarket or compatible part against measured geometry.
- Checking fit, clearance, or interference before manufacturing anything.
- CFD, FEA, and other simulation work that needs real surface data.
- Restoring or recreating a part you own or have the rights to, using its own measured geometry as a reference.
Prohibited use — you may not use a listing to:
- Illegally copy, reproduce, or manufacture a part that’s protected by a patent, registered design right, trademark, or copyright you don’t hold or have permission to use.
- Manufacture or market a component and represent or imply it is a genuine OEM part, or otherwise mislead buyers about its origin.
- Manufacture counterfeit parts, or facilitate someone else doing so, using data obtained through the Service.
As a seller, uploading data means you confirm you captured it yourself with authorization to do so, or otherwise hold whatever rights or permissions are necessary to publish it — see Section 4. As a buyer, a license under Section 7 doesn’t grant you any right to infringe a third party’s intellectual property; complying with the law for whatever you build from this data is your own responsibility, same as with any other reference material.
If you believe a listing was published without the necessary rights, or is being used to illegally reproduce a protected part, report it — every listing has a “Report an issue with this listing” link, or see Section 10 for how takedown requests are handled.
6. The Verified badge
A Verified badge means our review team confirmed who captured the listing and how, and cross-checked specific physical dimensions against the file before it published — see How verification works for exactly what that does and doesn’t cover. It is not a warranty, and it doesn’t guarantee the data is fit for any particular purpose beyond what was actually checked.
7. Buying a listing — license, not ownership
Purchasing a listing grants you a license to use that specific file, under the license tier you paid for, within the permitted use described in Section 5 — it does not transfer ownership of the underlying data or any intellectual property in it, except under an Exclusive Buyout license explicitly sold as such.
- Single-Project — use on one named internal project. Not for redistribution, resale, or use across multiple products.
- Commercial — broader internal commercial use as described on the listing at purchase. Still not for reselling or redistributing the raw geometry file itself.
- Exclusive Buyout — the terms stated on that specific listing at the time of purchase govern; typically full transfer and exclusivity for that data.
Redistributing, reselling, or publicly re-hosting a purchased raw file outside the scope of your license is a breach of these Terms, independent of any separate copyright claim the original scanner may have.
8. The bounty board
Posting a bounty, or adding your own offer to one, is a public statement of interest and the price you’d personally pay — it is not a binding purchase agreement, and no money is held, charged, or transferred by doing either. A bounty being “fulfilled” (someone linking a listing against it) doesn’t obligate you to buy that listing; you’d still go through the normal purchase flow if you want it.
9. Payments and refunds
Purchases are processed by our payment provider, who acts as merchant of record for the transaction — your payment details go to them, not to us. Prices are shown in USD. Because a license grants access to download a digital file immediately, purchases are final once the download link has been issued, except where the listing materially misrepresented what was delivered (e.g. the wrong vehicle/zone entirely) — contact us in that case and we’ll review it.
10. Intellectual property claims and takedowns
If you believe a listing infringes your rights (e.g. a trademark on vehicle badging, geometry captured without authorization, or a listing being used to illegally reproduce a protected part — see Section 5), report it. Every scan listing has a “Report an issue with this listing” link that goes straight to our review team; you don’t need an account to use it. We review every report — a listing isn’t removed automatically just because one was filed — but we can remove or suspend a listing while a claim is investigated, and sellers with repeated valid claims against them may be suspended or banned.
11. Prohibited conduct
Don’t: misrepresent a listing’s precision, equipment, or how it was captured; use the Service in any way that violates Section 5’s content policy; scrape or bulk-download the catalog outside normal use; attempt to bypass access controls on files you haven’t licensed; upload malicious files; use the bounty board to spam or manipulate demand signals; or use the Service for anything unlawful.
12. Service provided “as is”
3D Scan Garage is in early access. The Service, and any data on it, is provided as-is and as-available, without warranties of any kind beyond what’s explicitly stated for Verified listings above. We don’t guarantee the Service will be uninterrupted, error-free, or available at all times.
13. Limitation of liability
To the maximum extent the law allows, 3D Scan Garage won’t be liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim won’t exceed the amount you paid us in the 12 months before the claim arose. This includes damages arising from a third party’s use of a listing in violation of Section 5 — 3D Scan Garage reviews listings before they publish, but doesn’t manufacture, sell, or control what a licensee does with the geometry after downloading it.
14. Termination
You can stop using the Service and close your account at any time. We can suspend or terminate an account that violates these Terms, with notice where reasonably possible.
15. Governing law

We may update these Terms as the Service changes. Material changes will be reflected by an updated “last updated” date on this page.
